Terms of Service

These terms are an agreement between you (a tradesperson or trade business) and mt-deva limited (‘we’, ‘us’, ‘our’), which trades as CostYa. mt-deva limited is registered in England and Wales under company number 15768175, with its registered office at 71-75 Shelton Street, London, WC2H 9JQ. By creating an account or using CostYa (the ‘Service’) you accept these terms. If you do not accept them, please do not use the Service.

1. What CostYa is, and what it is not

CostYa is a job-intake and price-triage tool. It collects job enquiries, usually over WhatsApp, and helps you sort them so you can focus on the work worth winning. As part of that, the Service produces indicative budget ranges for jobs.

Those budget ranges are indicative estimates only. They are generated in part by automated and AI means, based on the information provided and on your own settings. They are not binding quotes, not a valuation, and not professional, surveying or legal advice.

You are solely responsible for setting your final prices and for any quote, contract or work you agree with a customer. CostYa is the ‘front door’ to a job. It is not full job management, accounting software, or a final quoting tool. You must not rely on a budget range as a substitute for your own pricing judgement.

2. Eligibility and your account

To use the Service you must be at least 18 years old and acting for a UK business or trade. You agree to provide accurate, current information when you sign up and to keep it up to date.

You are responsible for keeping your login credentials secure and for all activity that happens under your account. Tell us promptly if you think someone has accessed your account without permission.

3. Subscriptions and billing

A free plan is available so you can handle your initial enquiries. The Pro plan costs £29 per month and is billed monthly in advance through our payment provider, Polar.

A paid subscription renews automatically each month until you cancel. You can cancel at any time, and your cancellation takes effect at the end of the current billing period. Fees are non-refundable for part-periods, except where a refund is required by law.

We may change our prices with reasonable notice. Amounts may be subject to VAT where applicable.

4. Acceptable use

You agree to use the Service lawfully and only for its intended purpose. You must not scrape, reverse engineer, resell, or otherwise misuse the Service, and you must not attempt to interfere with how it works or with other users.

You agree to provide accurate enquiry information and not to upload or send unlawful, infringing or harmful content through the Service.

5. Your customers’ data

When you collect and submit your customers’ details and photos through the Service, you are responsible for having a lawful basis to do so and for giving your customers appropriate notice and obtaining any consent that is required.

In relation to that customer data, we act as a processor on your behalf and you act as the controller. We describe how we handle personal data in our Privacy Policy.

6. Third-party services

Messaging through CostYa uses WhatsApp, which is provided by Meta, and your use of it is subject to Meta’s terms. We also rely on other third-party services to run the platform. We are not responsible for those third-party services, and their terms apply to your use of them.

7. Intellectual property

We own the CostYa platform and brand, including the software, design and the CostYa name. Nothing in these terms transfers any of that to you.

You keep ownership of your own content and data. You grant us a licence to process your content and data so that we can provide the Service to you.

8. Availability and warranties

The Service is provided on an ‘as is’ and ‘as available’ basis. We do not warrant that it will be uninterrupted or error-free, and the budget ranges it produces may be inaccurate. To the extent permitted by law, we exclude all warranties that are not expressly set out in these terms.

9. Limitation of liability

Nothing in these terms limits or excludes any liability that cannot be limited or excluded by law. That includes liability for death or personal injury caused by our negligence, and for fraud or fraudulent misrepresentation.

Subject to that, we are not liable for any indirect or consequential loss, or for lost profits or lost business. Our total liability to you for all claims arising from or connected with the Service is limited to the fees you paid to us in the 12 months before the claim arose.

You acknowledge that a budget range is an indicative estimate, and that you must not rely on it as a substitute for your own pricing judgement.

10. Suspension and termination

Either of us may end this agreement. You may stop using the Service and cancel your subscription at any time, as described above. We may suspend or end your access to the Service if you breach these terms.

11. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from or connected with them.

12. Changes to these terms

We may update these terms from time to time. The ‘last updated’ date at the top of this page shows when we last did so. If you continue to use the Service after a change, you accept the updated terms.
